Netherlands spouse / partner visa for kennismigrant ( knowledge migrant )

I am a Citizen of India and have been in the Netherlands for quite sometime now. I got married this summer and as it happens with every other expat, had to start the paperwork of my wife. Let me tell you upfront, it seems to be an easy task, but beware! this process takes time.

I am writing this article specifically for my fellow Indian expats, but this should be a generic process for everyone (except few different documents).

Pre-requisites :
First and foremost, make sure you arrange the legalized marriage certificate ! Without this the IND won’t accept your application. You can try sending the application without this enclosure by post, but believe me after a month you will get a missing document letter :-)

Legalization of documents
There are two documents which needs to be legalized before submitting to IND.
(1) Marriage Certificate : Required while submitting the application.
As with any other document, getting a marriage certificate is not an easy task. So try to book a date at the District Court and file the marriage registration application. Once that is filed, you can come after your marriage date with your spouse and get everything signed and completed. Please make sure that you get your marriage certificate issued within 1 month of the marriage date otherwise things become complicated.
So assuming you have received the certificate, the next step is to get it legalized. A big big “oh no…….!!!”. Yes its a real pain to get it done :(
Following are the hierarchy’s you need to get the paper signed to get it legalized.
The ADM or the DM’s (their secretary’s specifically) should sign and send the document to the Home Department of the State.(They tend to ignore any such thing, but insisting and showing some favors helps :-) Now once in the State’s Home Department, this has to be signed by someone at the Secretary level. In general it takes around a month, but if you visit and chase it personally (my father did it for me), it gets done quite quickly. Once signed, the certificate is send back to the district where you need to collect it from. Then this document needs to be attested (with a sticker nowadays) from the Ministry of External Affairs (MEA) , Govt. of India. You DO NOT Need any signature from the Embassy anymore (ref here) ! Once you get the MEA stamp you are good to go!

(2) Birth Certificate : Required once your spouse is in NL to register at the Town Hall. Please note, this is not a “required” document for application, hence you get the advantage that with a legalized marriage certificate you can forward the application before even getting the birth certificate. The process of legalizing is the same as in case of Marriage certificate. There might be extra steps at the Tehsil/Gram sabha level depending on the place of birth if its not in a proper district.

Expat Center
Note : Since this article focuses on knowledge migrants, I will emphasize on this type of application only.

If your company is registered with the IND for bringing knowledge migrants or kennismigrant, things become very easy. Expat Center provides “one stop shop!” for all the application processes/registration/BSN application.

Application process
Please go to the ExpatCenter website to know the process of application in brief.
The list of documents needed are as follows:
(Note Migrant = ‘person applying in NL’; spouse = ‘Spouse of the migrant’)

1. The copy of the resident permit of the applicant
2. Last three months bank statement and salary slip
3. Download the form “Application form for following spouse or partner (requiring a provisional residence permit)” from this link
3.1 In the above form, fill the applicant’s employer’s details and signature with “Stamp”
3.2 Copy of Passport of migrant’s partner / spouse showing his / her personal details and the expiry date;
3.3 Signed copy of the pass photo form in the above form. Get your spouse to sign/scan and send the form and you can copy the photo and use it
3.4 Form M46 as in the above link. Do not sign it, just fill it!

4 “Copy” of the legalized marriage certificate
5. Note, birth certificate is “not important” at this time!

Rest of the things in the above form are self-explanatory. If not use the comment section to aks me :-)

Once you have the documents and filled up the form, you are good to go.
Important !!! Take my advice, do not send the form as-is. Visit the Sloterdijk branch of IND, show all the documents (they will say its Expat Center’s job, but will recheck anyhow!). Then visit the Expat Center at WTC Amsterdam. An IND employee Marcel helped me a lot by clarifying what is missing and all. So its highly recommended to visit the branch. Make sure you get an Expat Center sticker. This you should put on the form which will help IND to identify that the form process for Expat Center will be followed.

Once you are done with verification,send the documents by Post at the address mentioned on the form Immigration and Naturalisation Service

Now wait …………….

I received the confirmation in just 2 weeks !

A person from Expat Center will give a call to your employer to fix an appointment date (this can be shifted if needed, as I shifted to full 2 months!)

Once IND sends a letter for approval, your spouse should call the VFS-Global and arrange an appointment to get the MVV sticker on Passport. In the meantime make sure the “Birth Certificate” is legalized and ready. The embassy while putting the MVV in India will need the original Marriage Certificate with legalization and passport.

Hurrrayyyyyy, everything is done and your spouse is ready to come to NL !!!!! :-)

Once he/she arrives in NL, you need to visit the Expat Center office at the appointment date/time to complete other formalities. Make sure you have the “Original birth certificate” and your rental agreement!

At Expat Center, you will receive your BSN (SOFI number), resident permit and get registered at TownHall.

Please note that the resident permit will be valid only for 1 year in the beginning. After one year you can get it extended to the same duration as yours.

I feel I have provided enough details to get the application process started, and hopefully get completed without issues. If you have any doubts, please feel free to put a comment and I will revert back!

One of the commenter (Abhiney) recently found out (ref comments below) that only if you are staying in Amsterdam/Rotterdam/Brabant you can use ExpatCenter services. Basically the issue is that you should be registered in a Gemmente where ExpatCenter has jurisdiction on. Hence discuss with them upfront!

    Hi Abhi,

    My name is Jay and i got married to my girlfriend this year in Feb and ever since then i am trying to get my documents legalized but still i haven’t got all the documents from the ADM’s office. anyways my question is that my wife called IND and asked them if we will need to register the marriage in Netherlands before we apply for MVV?? she was told that she dont need to register the marriage if there is a legalized copy of the marriage certificate. Also me and my wife have called IND on several occasion and every time we have got different answers from different agents on the phone. i am very much confused and to be honest, totally pissed off. my wife is the citizen on NL and i am an Indian citizen and before we got married she got herself a single statement from the city hall and it is still valid for 6 more months, as i was not able to get a single statement from my state Gujarat, we decided to get married and get marriage certificate legalized . the problem is that if she does not register herself as married then she is still single and also have the marriage certificate. we dont know whom to consult and whom to ask as minbuza never replies on emails and IND tend to give different info every time.

    pls help me clear the process as i was told that registering of marriage will take 2 months and MVV with take 3 months and it will be all together 5 months, i have the certificate of civic integration exam valid till November 2012 and as i am still in the process of getting my documents legalized from the shity Indian govt agencies, i dont think i will be able to pull this in time.

    Hi Jay,
    My first question, where did you get married? If you got married in India (as I guess from your comment), you will have to get the marriage legalized back in India and only then IND will accept it as a proof of marriage. Since your wife is a NL citizen and kennismigrant is not applicable, you will have to go through the lengthy process of first applying form M46 to register the marriage in NL (using legalized certificate) and only after that you should be able to apply for MVV.

    If you want I can also give you a contact number of a lawyer I know, who can help you (of course he will charge a lot of fee!).

    What kind of Visa does your partner have? If he is a kennismigrant then your dependent visa automatically allows you to work here without doubt. Hence you can come here, search for a job and start working. But if its a different kind of Visa then you can come here as dependent but cannot work, and if you would like to work, then after coming here, you will have to apply for change of purpose.
    Please let me know your situation and then I can try to help in a better way.

    i want to ask you something, Abhi is it true that per april 2012, the IND has decided to NOT allowed a partner of kennismigrant to get to NL unless they’re married?

    because my situation is quite crucial. haha.
    its been a long struggle to get a legal documents (and of course a lot of money too) then suddenly just now, friends of my partner said that bad news….

    As far as I can search I could not find such kind of information regarding a partner. Can you please point me to a source etc. so that I can call IND and verify?

    If you can get it from your partner’s friend, it will be great, otherwise I can give a call to IND in a day or two to confirm.

    Thank you for this useful information. I am a highly skilled migrant, and I have a question about bringing a spouse to the Netherlands under the family reunification procedure: is there some minimum amount of time that I must live in the Netherlands before I can apply for my spouse to join me? 

    I noticed that I have to submit three months’ payslips with my application. Does this mean that I can apply for my spouse to join once I have been working in the Netherlands for three months? Or is there an additional waiting period?

    Dear Thomas,

    There is no time limit as such. IND wants your salary slip to check the consistency etc and also the amount you earn as they want to ensure that you can support your wife. You can add your contract which should mention when you started and how long is it applicable. 

    In any case I will suggest that you go ahead and apply if you have all the documents.

    thanks for your article. i know you are only writing as an expat but i was wondering if you could help me. my boyfriend and i will be getting married in denmark next week (9th march 2012). after that we come back to the netherlands (i am a resident of india) and start the M46 procedure. my visa runs out on the 24th of april 2012. do you think the M46 will be completed within this time? i am worried because if it’s not completed, will i have to go back to india and then come back when it’s done? or will they let me stay here till it’s finished? thanks for your time. mimansa

    What is your and your boyfriend’s status (in terms of nationality and permits)? Is anyone of you a Kennismigrant in Netherlands?
    In general M46 may take one or two months. Since you are getting married, I assume there are higher chances of getting M46 procedure done soon.
    Will try to give more suggestion when you tell me the answers to above questions.

    I am applying for NLWP long term along with my wife.
    Is my wife BC legalised is mandatory? As it takes some time to get it attested, can i travel without it and ask for some time to produce the same at NL?

    Your wife’s birth certificate is mandatory. It is required to be registered in the Netherlands. If you have to stay long term, you have to register. This means you might have to delay the travel plans for your wife before bringing her over. This will not delay your papers. Please contact IND (http://english.ind.nl/contact/) and they might suggest a workaround, but I cannot assure that :(

    Hi!
    I have Birth Certificate of my wife which only bears her first name. Although, rest of the certificates like passport and educational certificates has her full expanded name. The birth certificate bears an Apostille stamp (Implying that the certificate is legally valid).

    My question is, will this be a problem while getting her registered here at Gemeente? M<y marriage is already registered.

    If they go by the rule, then most probably you might have a problem. But if you can try to convince them with the date of birth on passport as well as on the certificate, then they might agree. But remember, its all upto the officer who is attending. Sorry I cannot say for sure.

    Replying back to Abhiney, you have mentioned that our employer has to fill one form and declare that you are working for them. Where to find this form?

    Its the page where your salary,date of employment etc is mentioned. The Expat center forms is just a 7 page form, and its clearly mentioned the employer has to fill it up page 2 and 3 and sign on page 3 with a stamp. I will advise you to visit your nearest Expat Center(you don’t need appointment) and get the filled up form verified.

    I am writing to you on behalf of several Indian MBA students here from Utretch area. We are exploring to get our wives here on MVV; however, so far we have found that is almost impossible to get MVV for our wives since we are not earning and we are on student MVV ourselves.
    I wanted to check with you whether you have any information in this area, or if you can point us to right direction.

    If you have the confirmation, your spouse can visit the Embassy, get the MVV stamp and come to NL as soon as possible. I don’t think there is anymore wait necessary. I will suggest that you please contact the embassy in the home country.

    I am a kennismigratnt holding resident permit.
    I am filing dependent visa application for my wife who is in India currently.
    I have below query.
    My wife’s name on our legalized marriage certificate (maiden name) is different than her name on passport (married name).
    Will this create any problem for dependent visa application?
    Do I need to fill any form or declaration & submit to IND along with application form?

    The date of issue of passport is later than the date of marriage, correct? I cannot say for sure, but it should not create any problem. I assume the marriage certificate has the photo of your wife.

    I had a query regarding the Request for Advice Preceding the Actual Application for a Regular Provisional Residence Permit (MVV). 
    Do I have to submit this document? Or, can I directly apply for MVV for my wife?
    And if I do have to make this request first then does she have to take the the civic integration examination in India as a prerequisite?

    If you are applying from India, you have to apply for the request for advice. Then you will get a repsponse from IND and if its positive, they will intimate the NL embassy in India so that an MVV sticker is put on your wife’s passport. Using the MVV she comes here and then you apply for permit.

    If you are a knowledge migrant, please check if you can use Expat Center services. If yes then as I explained, you don’t need to go through much of the red tape :-) Moreover your wife will not need to apply for Civic integration examination as well.

    It all depends on your situation or to say the kind of permit you have. Please specify that so that I can give more clear idea.

But for a normal visa application it can even take 3 months. The sad thing is that if you call IND, they will say officially the time limit is 6 months!

    I don’t know whether there is any condition as such. A legal marriage certificate is required though. Hence if its a legal marriage age in your country, you will of course get the marriage certificate, which you can use for MVV.

    I am Navin, a PhD Student at University of Groningen. I am going to apply visa for my wife, who is in India right now. My Visa states i am an Onderzoeker Richtlijn 2005/71/EG.

    Is the visa process same as such in case of Kennis Immigrant. 

    Can you please tell me if i should first register my marriage at Gemente (There is no expat center in Groningen) before applying for visa or i can directly apply for MVV for my wife.

    I cannot say for sure that the process is the same. But have a look at the documents below :

    Looking at it suggests that the procedure might be the same. Since you cannot use Expat Center, you will have to get the legalized marriage certificate and get the marriage registered, before applying for MVV. But please do call 09001234561, the IND help desk and they can help you in detail.

    Thanks for your reply. I tried to confirm with the IND regarding applying visa for my wife. As of 2011 there is slight changes with application procedure. First, the IND said its not necessary to register the marriage at Gemente. I can directly apply for visa using a form called Advice regarding application of MVV.
    Any idea about this..

    this does mention about some forms,not specifically. I will advice you to visit one of IND’s locations (http://english.ind.nl/contact/Adressen/index.aspx) personally and talk to them. You can take an appointment or just visit there and the information desk will help you. They are very helpful and will even provide you the relevant forms.
